SRVN1 is currently in BETA. Features, policies, and data practices may change at any time without prior notice. By using this service during the beta period, you acknowledge and accept the evolving nature of the platform and its terms.

1. Acceptance of Terms

By accessing, browsing, or using SRVN1 ("Service", "Platform", "we", "us", "our"), you ("User", "you", "your") agree to be bound by these Terms of Service and Privacy Policy (collectively, "Terms"). If you do not agree with any provision herein, you must discontinue use immediately. Your continued use of the Service constitutes irrevocable acceptance of these Terms and all future modifications.

2. Service Description

SRVN1 is a personal thinking partner powered by the proprietary PNR (Pelium-Nelium-Relium) Framework. The Service helps you navigate daily life, career decisions, relationships, and thought patterns by providing behavioral insights and response generation for personal reflection purposes only.

2.1 Beta Status

The Service is provided in BETA and is offered on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding availability, accuracy, reliability, or fitness for any particular purpose. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without liability.

2.2 Not Professional Advice

SRVN1 is a personal thinking and reflection tool. It does not provide professional advice of any kind. It is not a substitute for qualified professional guidance when needed. You acknowledge that you use the Service at your own risk and that the Service should not be relied upon for critical or emergency decision-making.

3. User Accounts & Sessions

Sessions may be accessed through purchased session keys or promotional beta access codes. You are responsible for maintaining the confidentiality of your session key. We are not liable for unauthorized use of your session key.

4. Payments & Refunds

Paid sessions are processed through Stripe. All payments are final and non-refundable unless required by applicable law. Session keys expire after the designated time period regardless of usage. We reserve the right to modify pricing at any time.

6. Content Moderation

The Service employs automated content safety systems. Inputs that are flagged for containing harmful content may result in immediate session termination. We reserve the right to review, log, and retain flagged content for safety and compliance purposes. Flagged content may be shared with law enforcement if required by applicable law.

7. Intellectual Property

All content, design, code, algorithms, the PNR Framework, and associated trademarks are the exclusive property of SRVN1 and its creators. You may not reproduce, distribute, or create derivative works from any part of the Service without prior written consent.

Analysis reports generated for you are licensed for your personal, non-commercial use only. You may not redistribute, publish, or commercially exploit generated reports.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SRVN1 AND ITS CREATORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SESSION IN WHICH THE CLAIM AROSE, OR $4.99 USD, WHICHEVER IS LESS.

10. Indemnification

You agree to indemnify, defend, and hold harmless SRVN1 and its creators, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator resides, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority. You waive any right to participate in class action lawsuits or class-wide arbitration.

13. Modifications

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of the Service after any modification constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and SRVN1 regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.

17. Supplemental Provisions

17.1 Service Improvement & Data Utilization

By using the Service, you grant SRVN1, its successors, and assigns a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to collect, store, process, analyze, aggregate, de-identify, and otherwise use all data, inputs, outputs, conversation logs, session data, behavioral patterns, interaction data, and any other information submitted to or generated through the Service ("User Data") for any purpose, including but not limited to: (a) improving, training, fine-tuning, and developing the Service and its underlying analytical models, algorithms, and frameworks; (b) developing new products, services, features, and technologies; (c) conducting research, analysis, and benchmarking; (d) generating aggregated and anonymized datasets; and (e) any other lawful commercial purpose. This license survives termination of your account or discontinuation of your use of the Service. User Data may be retained, processed, and utilized indefinitely regardless of account status. De-identified and aggregated data derived from User Data is not considered personal data and may be used without restriction.

17.2 Conversation & Session Logging

All interactions with the Service, including but not limited to user inputs, system-generated responses, session metadata, behavioral interaction patterns, and navigational data, are logged and retained as part of normal Service operations. This logging is essential to providing, maintaining, securing, and improving the Service. By using the Service, you expressly consent to the comprehensive logging of all session activity. Logged data may be reviewed by authorized personnel for quality assurance, safety, compliance, model improvement, and operational purposes.

17.3 Beta Program Data Practices

During the beta period, expanded data collection and analysis practices are in effect to facilitate rapid service development and improvement. Beta users acknowledge that data collection during this period may be more extensive than in the general availability release. Participation in the beta program constitutes informed consent to these expanded data practices. We may modify the scope and nature of data collection during the beta period without additional notice.

17.4 Waiver of Data Deletion During Beta

To the extent permitted by applicable law, beta users acknowledge that data deletion requests may be subject to extended processing timelines and that certain de-identified or aggregated data derivatives may be retained even after deletion of source data, as they no longer constitute personal data. The exercise of data deletion rights does not affect the license granted under Section 17.1 with respect to data already processed or incorporated into aggregated datasets or model improvements.
